1. Acceptance of Terms

By creating an account, accessing, or using the AutoShopMS application ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not register or use the Service.

2. Nature of the Service

The Service is a software tool provided "as-is" to help you manage your garage or workshop operations (billing, inventory, customers, and communications). It is not a substitute for professional legal, accounting, tax, or financial advice.

3. User Accounts & Responsibilities

• You must provide accurate and up-to-date information during registration and keep it current.
• You are responsible for safeguarding your username, password, and any activity under your account.
• You must ensure you have all necessary consents (including from customers) to store and process the data you enter.
• You must not use the Service for any unlawful purpose or in violation of applicable laws.

4. Data Privacy & Security

• We store your data securely and use it solely to provide the Service.
• You own the business data you enter. We do not sell your data or your customers' data.
• You are responsible for complying with all applicable data-protection laws in your jurisdiction (for example, India's IT Act and the DPDP Act) regarding the personal data you collect from your customers.
• You may export or delete your data at any time through the download and management features of the Service.

5. Acceptable Use & Prohibited Conduct

• No spamming: campaigns sent through the Service must comply with applicable telecommunication and marketing regulations (e.g., TRAI DND rules in India).
• No reverse engineering, reselling, or unauthorized redistribution of the Service.
• No attempts to breach security or access another shop's data.

6. Intellectual Property

The Service, its design, logos, and software code are owned by the AutoShopMS developers and are protected by applicable intellectual-property laws. You receive a limited, non-transferable license to use the Service for your business only.

7. Disclaimer of Warranties

The Service is provided "as-is" and "as-available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the fullest extent permitted by law, the developers and founders of AutoShopMS shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of, or inability to use, the Service. Our total aggregate liability shall not exceed the amount you paid to use the Service within the six (6) months preceding the claim. Where the Service is offered free or on trial, your sole remedy is ceasing use of the Service.

9. Data Backup Responsibility

While we take reasonable measures to protect your data, you are responsible for maintaining appropriate backups of critical business records. Invoices and reports can be downloaded by you at any time.

10. Third-Party Services

The Service may integrate with third-party platforms such as email providers and WhatsApp (Meta Cloud API) to deliver features. We are not responsible for the availability, functionality, or content of third-party services. You are responsible for complying with those third parties' own terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access to the Service for violations of these Terms, or for reasons of security, fraud, or legal compliance. On termination, your rights to use the Service cease, but the provisions of these Terms that by their nature should survive shall remain in effect.

12. Changes to the Service & Terms

We may update, modify, or discontinue features of the Service at any time. We may revise these Terms from time to time; the updated Terms will be posted in the application. Continued use of the Service after changes constitute acceptance of the revised Terms.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the courts at the location where the Service provider is registered.
